Buying property in Türkiye: what gets checked and in what order

Check your right to buy, the address, the property documents and the payment terms before the deposit, not after it.

Ownership transfers only at the Land Registry; everything before that is preparation and checking.

In Türkiye a signed purchase agreement does not make you the owner. Ownership passes only when the transfer is registered at the Land Registry, and several checks must happen before you pay anything. The Ministry of Foreign Affairs guide, as checked on 6 November 2026, advises verifying the property, the seller and the zone before committing. This guide walks through those checks in the order they matter.

When do you actually become the owner?

A signed purchase agreement does not transfer ownership. Under Article 26 of Law No. 2644, a contract that aims to transfer ownership must be concluded officially at the Land Registry office (Tapu Sicil Müdürlüğü) where the property is located. The Ministry of Foreign Affairs guide adds that a notarised promise to sell (satış vaadi sözleşmesi) can be signed before that, but it does not transfer ownership.

The practical consequence is that the moment to treat the property as yours is the registration at the Land Registry, not the signature of the promise to sell. Until that registration is completed, you hold a contractual claim, not the property.

Check you are allowed to buy this property

The zone check comes before any payment. The Ministry of Foreign Affairs guide says you need permission from the military authorities in the region before buying. If the property is inside a security zone, sale to a foreigner is impossible. Confirm this with the regional military authority before you transfer any money.

Pull the property file before you pay

Before you sign anything, ask the Land Registry for the property's record. The Ministry of Foreign Affairs guide tells buyers to check whether the property is subject to limited real rights, a mortgage (ipotek) or any other obstacle to sale.

The Ministry of Foreign Affairs guide is specific about the order: do not sign a legally binding contract and do not pay until you have the registry information about the property and have checked the seller. That means the file pull and the seller check come before the deposit, not after.

Why a missing iskan changes your exit

According to one law firm's assessment as of 25 April 2026, a property without a valid occupancy permit (iskan, yapı kullanma izin belgesi) can be hard to mortgage and materially harder to resell at a normal price. The buyer pays for the flat now but may find the exit blocked later.

The same assessment, as of April 2026, notes that the usual reason the permit was never issued is a deviation from the approved project. A missing iskan therefore signals something more than a lost certificate.

Agree the payment route before the deposit

For transfers connected with Russia, Turkish banks often ask for additional documents on the origin of funds. One law firm's commentary, checked on 6 November 2026, notes this pattern and its consequence: the payment route should be agreed before any deposit is paid.

In practice, as of November 2026, ask the bank which origin-of-funds documents it will want and settle the route with it before any deposit is paid.

Documents you must have at the Land Registry

A foreign buyer presents an identity card or passport at the Land Registry office. If you are required to hold a residence permit, bring the ikamet tezkeresi as well. The Ministry of Foreign Affairs guide lists these as the documents for a foreign individual's application.

If you act through a power of attorney issued abroad, you need the original or a certified copy, together with a translation. The guide specifies this requirement for cases where someone else signs on your behalf.

Declare the real price, not a figure below the tax value

The transfer fee (tapu harcı) is calculated on the declared price of the transaction, and that price cannot be below the property tax value (emlak vergisi değeri). Article 63 of Law No. 492, as read in General Communiqué No. 56, sets this rule. Declaring a lower figure than the tax value is not a saving.

If the price is later found to be understated, the transfer fee on the difference is assessed to both buyer and seller, plus a 25% tax-loss penalty (vergi ziyaı cezası), under the same provision.

How long the registry appointment itself takes

If the documents are in order, the transfer at the Land Registry usually finishes the same day. One real-estate agency reports, as of 12 October 2026, that this part of the sale is not what takes longest for a foreign buyer.

The time before the appointment is what takes longest. By the same agency's account, the valuation report and the foreign-exchange purchase document (DAB) are the steps that consume most of the waiting.
