Emlak vergisi: who pays, when, and how to check the debt on an address

Property tax and the waste charge, the two payment deadlines a year, checking for debt through e-Devlet or the municipality, and why debt surfaces at the sale.

The law charges the tax to the owner, the usufruct holder or whoever manages the property as owner, and the e-Devlet services available depend on the municipality. An unpaid tax can block a title transfer.

The law charges emlak vergisi to the building's owner, the holder of a usufruct right, or whoever manages the property as owner; the land tax follows the same rule for land. According to the official pages of e-Devlet and the Ulus Belediyesi service, checked on 23 October 2026, the available municipal services depend on which municipality is connected.

Who owes the tax, and how shared ownership changes the answer

Under the Property Tax Law of 11 August 1970, the building tax is charged to the building's owner. If a usufruct right exists over the building, the holder of that right is the taxpayer instead. When neither an owner nor a usufruct holder exists, the person who manages the building as its owner is liable. The land tax follows the same order for land: the landowner, the holder of a usufruct right, or, in the absence of both, the person managing the land as owner. This means the reader first needs to establish which category applies to them before any payment is made.

Shared ownership changes the answer. Where co-owners hold defined shares, each is liable in proportion to their share. That means a co-owner with a 30 percent share is liable for 30 percent of the tax. Where ownership is joint without defined shares, the co-owners are jointly liable: the municipality can pursue any one of them for the entire amount. The reader should confirm which form of ownership applies to their property, because the difference determines whether they can be asked for the whole tax or only their part.

The law names only these three categories as the taxpayers. A tenant is not among them, because the law does not list tenants as liable. The first step for a buyer is therefore to establish their legal relationship to the building or land before the payment window arrives.

How to check municipal property tax debt on e-Devlet

The municipalities page on e-Devlet brings together municipal services in one place, but the exact set depends on which municipality is connected. Among the services that can appear are municipal debt operations, property tax notification, obtaining a copy of the property tax notification or a cadastral value certificate, and looking up declaration details. A reader who wants to check the debt on an address should log in and look for the debt operations entry for the relevant municipality; if that entry is absent, the municipality may not offer it through e-Devlet, and the reader will need to ask the municipality directly.

For the Ulus Belediyesi debt check service, the user must first complete identification before the service can be used. This is confirmed only for Ulus Belediyesi; for other municipalities, check the service page for the steps required.

Why an unpaid tax can stop a title transfer

When a building or land is transferred, the tapu office checks the municipal tax debt through the municipality's system. Since the provision dated 11 October 2021, the Property Tax Law provides that if a debt exists, the transfer is normally not carried out. This applies to both buildings and land.

The law allows exceptions, which are not covered here. If you are told a debt will not block the transfer, confirm this with the tapu office before relying on it; the default position is that an outstanding municipal tax debt stops the transfer.

For a seller, this means the tax debt must be cleared before the transfer can go through, unless an exception applies. For a buyer, the safest course is to treat any known municipal tax debt as a potential blocker and to verify its status before the appointment at the tapu office.

When the first instalment is due

The first instalment of the property tax is paid in March, April or May.

Consequences of late payment are not covered here; if you miss the window, ask the municipality about any late charges.
